Payments

You’re required to pay a deposit  within 7 days of the signing of the charter contract, in order to confirm your booking. We will inform you of the amount of this deposit at the time of booking.  The remaining balance needs to be paid 10 weeks before the start date of your booking. If the booking is less then 10 weeks in the future, full payment must be made at the time of booking. We reserve the right to cancel your booking if the deposit or the full contracted amount has not been paid on time and should this happen, it will be considered as a “Cancellation by Client” for refunding purposes if there is any to be made. The person who makes the booking on behalf of others will be deemed as the “principal booker”. The principal booker is responsible for making the payments outlined in the contract. In case of a cancellation of a booking the cancellation and refund policy set out below shall be applied.

Contract

Once a booking is made and the deposit is received, you will receive a confirmation for your booking. If there is any inaccuracies in this confirmation please let us know immediately as it may not be possible to make changes at later stages. We cannot accept any responsibility for unnotified incorrect information. However, we will do our best to correct any mistakes as long as we are notified. Any costs incurring as a result of incorrect declaration of information by you must also be met by you.

English Law shall be applicable should there be any disputes arising between the client and Gulet Escapes Limited. If the client resides in Scotland or Northern Ireland then the proceedings can be brought to court in their respective residential countries or England.

Cancellation by Client

If you decide to cancel your booking we implement the following charges. The time periods stated are prior to the scheduled departure date. The cancellation charges relate to the total charter price.  Please note that the cancellation needs to be made in writing (email or recorded delivery post).  The date it is received by us will be deemed as the date of the cancellation.

Changes by Client

Although we try our best to accommodate any changes requested by our clients, we cannot guarantee that we will always be able to meet such requests. Any alteration request made by our clients are subject to availability. Please be aware that any change to your booking may result in changes in the price of your booking in which case this extra amount should be paid by the client. Requesting a change on the dates of the contracted booking shall be considered as a cancellation and will be subject to cancellation charges.  Should such a change need to be made on the booking a rebooking with the new dates will be necessary.

Cancellation by Us

We make every effort to avoid cancellation from our side. In exceptional circumstances, including but not limited to “force majeure” [i], we may have to cancel a booking you have made. For this reason we reserve the right to cancel your holiday, in which case we will offer you an alternative holiday in the same or similar quality or a full refund of your booking.

Some of the holidays we offer may require a minimum number of bookings (e.g. tours and cabin charters). If we do not receive the minimum number of bookings for a particular holiday or tour we reserve the right to cancel this particular holiday or tour. If we do so our clients who booked a place in the cancelled tour or holiday will be informed as soon as reasonably possible  and their payments made for the cancelled holiday or tour will be fully refunded

Changes by Us

While minor change can occur due to reasons such as weather conditions or availability, major changes are a rarity. We reserve the right to make changes on your booking where necessary. You will be informed of any changes before your departure.   Examples of changes: A change on your route (partially or entirely) due to severe weather conditions on the route you selected; a change on your selected catering option due to availability.

Health & Safety and General Medical Issues

All the boats we offer agree to health and safety standards set out by the International Maritime Organization (IMO) and are inspected by the authorized bodies of the countries they are registered to. If any boat fails to do so and should this failure result in an injury or other medical problems for any of our clients, the legal owner of the boat shall be deemed liable.  The captain of the boat will inform you of the health and safety rules while on board as you embark on your boat. You must follow these rules in the entirety of your holiday. If you fail to do so, you are fully responsible for any harm or cost that may incur as a result of this failure.

If a medical problem happens while you are on board the captain of the boat you are on calls for emergency health unit in the country you are in and a sea ambulance is sent to take care of you as soon as possible.

If you are travelling with a disabled person please inform us at the time of your booking so that we can try and make the necessary arrangements for your safety and comfort. Boats generally have lots of steep steps and narrow passages, as well as a narrow gangway for alighting the vessel. Depending on your disability, it may not be suitable for a disabled person to go on a boat holiday. Contact us to discuss beforehand to make sure you have best options.  Please be aware that any persons travelling with a disabled person is fully responsible for their well being.

Insurance

You must ensure that you have sufficient insurance to cover all aspects of your holiday such as personal accident, health, injury and travel insurance. Clients are fully responsible for any costs that may incur to them or anyone in their party as a result of inadequate insurance cover.

Special Requirements

Although we cannot guarantee that we will meet every special requirement you make, we make our best effort to meet your requests such as dietary requirements. If you have any special requirements please let us know before your departure so that we can work towards meeting it.

Visas

Visitors to Turkey are required to get an electronic visa before travelling. Visit the Republic of Turkey e-visa system to apply online. Visas cost $20 (US) and can be paid for by Mastercard or Visa (credit or debit). UK passport holders will need to purchase visas for all those travelling including children.

Please Note: As of 2014, visas can no longer be purchased on arrival in Turkey and must be organised beforehand.

Information on our Website and on our Marketing Material

We make every effort to reflect the accurate and up-to-date information about the boats and holidays we offer on our website and other marketing materials such as newsletters.  However, due to the nature of yachting industry, some minor changes are occasionally made to the boats (e.g. improvements, availability of water toys). We try to reflect such changes in our marketing material straight away but missing information is possible. Please ensure that you ask us about any information you’d like to know about a boat or a holiday at the time of your booking.

Clients Conduct

Our clients, by booking with us, accept that they will act properly throughout their holiday and they will not put themselves or anyone in their group at risk by conducting themselves in ways that should be considered as improper or dangerous.  In cases when a client’s conduct puts the navigation of the boat at risk, or offends the other guests, or has a major detrimental impact on the enjoyment of the holiday by other guests or safety of the people on boat, we reserve the right to terminate their contract and offer no refund.

Data Protection

Your personal data will be kept safe and never be passed onto third parties.

 

 

[i] Force majeure generally includes risks beyond the reasonable control of a party, incurred not as a product or result of the negligence or malfeasance of a party, which have a materially adverse effect on the ability of such party to perform its obligations, as where non-performance is caused by the usual and natural consequences of external forces (for example,natural disasters, wars, armed conflicts, death, etc), or where the intervening circumstances are specifically contemplated.
